 By using our services, you're agreeing to these rules to ensure a safe and supportive space for everyone:

1. Nature of Service
The Services provided by Nearby Ears are strictly for empathetic, non-professional, and non-advisory listening. Our Listeners are not licensed therapists, psychologists, legal advisors, or members of the clergy. The Service is a peer-to-peer listening platform and is not a substitute for professional medical, therapeutic, or legal advice, diagnosis, or treatment.

2. No Confidentiality for Illegal Acts
You acknowledge and agree that the confidentiality of your session is conditional and does not extend to communications involving or relating to:

• Past, present, or future criminal activity, including but not limited to acts of violence, terrorism, child abuse or neglect, elder abuse, human trafficking, or threats of harm to oneself or others.
• Any ongoing or planned illegal act.

3. Duty to Report and Limitation of Liability
You understand and accept that Nearby Ears and its Listeners have an ethical and, in certain jurisdictions, a potential legal duty to report confidential communications if they include clear and imminent danger to an individual or the public, or as required by law. By using this Service, you expressly waive any right to confidentiality in such circumstances and agree to hold Nearby Ears, its employees, agents, and Listeners harmless from any and all liability arising from such a report.

4. User Indemnification
You agree to indemnify, defend, and hold harmless Nearby Ears, its affiliates, officers, directors, employees, agents, and Listeners from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney's fees) arising from:

• Your breach of these Terms, including the confession of a crime or illegal act during a session.
• Any illegal activity you have confessed to or are planning.
• Any third-party claims brought against Nearby Ears as a result of your communications or actions.

5. No Privilege
You acknowledge that no legal privilege of any kind (including attorney-client, doctor-patient, or priest-penitent) is created by your use of the Services.

6. Respect & Kindness: We encourage open conversations, but please treat others with respect and kindness. Hate speech, harassment, and abusive language won’t be tolerated.

7. Confidentiality: Your conversations are your own! We promise to keep everything shared within our platform confidential. However, we may need to disclose information if there’s any risk of harm to you or others.

8. Service Disclaimer: Our platform offers empathic listening and a safe space. However, we are not a substitute for professional mental health services. If you need more specialized help, please seek out a licensed professional.

9. Usage Guidelines: Enjoy your time with us! However, please avoid spamming, advertising, or disruptive behavior on the platform.

10. Age Restrictions: You must be at least 18 years old to use our services. If you're under 18, please have permission from a parent or guardian.
